مختصری از ماجرا ها، به زبان یکی از کامنت گذاران digg برای دوستانی که از کلیت ماجرا ها بی خبر اند.

SCO's business was failing because Linux was competing them out of business. They tried to exrtact infinite IP-licensing profits from Linux vendors by trying to prove they owned the rights to Linux. They claimed IBM illegally contributed UNIX code to Linux and therefore everyone using Linux owed SCO money. Of course, IBM wasn't going to deal with that shit, so they've been fighting hard in court since ~2003. Meanwhile Novell comes forward and says to a Utah court: "SCO doesn't own UNIX, we do!" Therefore, SCO has been illegally licensing Novell's IP (UNIX) to big cos like Sun and Microsoft. Well, today is a landmark day. The court ruled that Novell owns UNIX, SCO owes Novell an absolute shitload 'o cash (from the IP licenses with Sun and Microsoft) and IBM is free to pursue counter-claims against SCO effectively putting them out of business. Don't forget: Microsoft was behind it all. They were paying SCO's legal bills all along. This is twofold awesome.

OpenGroup owns the TRADEMARKS to UNIX and UnixWare. They get to decide who can make use of those terms when referring to products, as DuckFOO indicated above. Novell owns the COPYRIGHTS to the UNIX and UnixWare products, which means they have control over how the actual UNIX software is used.

With Novell now firmly in charge of SCO's, excuse me, Novell's Unix and UnixWare IP, SCO's Unix business is now road kill. The only real question I have at this point is, "When will SCO's bankruptcy proceedings start?"

SCO's Unix reseller partners should now run, not walk, to become Linux resellers. If you're stuck with supporting SCO UnixWare and OpenServer, it would be wise to visit Novell PartnerNet, say by the next business day, and start talking partnership.

Novell owns the UNIX SVRX and UnixWare copyrights; Novell has the right, at its sole discretion, to direct SCO to waive its claims against IBM and Sequent; and SCO owes Novell payment for the UNIX SVRX licences it sold to Microsoft and Sun.

Analysis -- The day Linux fans have been waiting for since SCO attacked Linux on May 12, 2003 has finally arrived. U.S. District Court Judge Dale Kimball has ruled that Novell, not SCO, owns Unix's IP (intellectual property) rights. This, in turn, means the end of SCO's cases against IBM.

SCO شرکت سارق و عوضی ای است که بارها توسعه گران لینوکس و یونیکس را به دزدی حقوق معنوی ای که هیچ وقت نداشته متهم کرده بود ؛ من از این خبر خیلی خوشحال شدم .
وقتی خود SCO کدهای لینوکس رو دزدیده و متعاقبا ناول رو به سرقت از یونیکس متهم کرده طبیعی است که اگر وکلای ناول بتونن خلافش رو ثابت کنن برندهء پرونده هستن .

ناول نسبت به IBM کوچکتر و به دلیل کسب و کارهای جدیدش خیلی فعالتر است و معلومه تیم حقوقی خوبی رو برای دفاع آماده کرده بوده .

اول، دادگاه مشخص کرده که SCO حق کپی محصولات تولید شده از زمان تحویل گرفتن یونیکس از ناول در سال 1995 رو داراست.
هر چند ما هنوز اعتقاد داریم وقتی SCO در اون سال بیش از 100 ملیون دلار به ناول داد همه چیز رو خریده.

دوم، SCO مالک همه حقوق توسعه ورژن های آتی UnixWare هست و همچنین حق استفاده از نام تجاری UnixWare رو در سطح جهان داراست.

سوم، مالکیت OpenServer و پلتفرم Mobil Server اون تغییر نکرده و اینها بخوبی در بازار مورد استقبال قرار گرفته اند.

چهارم، دادگاه هنوز شکایت ما علیه ناول در مورد قرارداد لیسانس مربوط به توزیع لینوکس ناول رو کنار نگذاشته.

پنجم، شغل ما شکایت کردن به دادگاه و تکیه کردن به رای دادگاه نیست، بلکه توسعه تکنولوژیهای SCO برای نیازهای بازار هست (همون جریان قمار بازست!).
